Tās tā kā būtu apvienības HIV.LV rūpes par saviem klientiem? From 1. 1. 2010, the new Penal Code, No 40/2009 Coll., including Amendatory Act No 306/2009 Coll. is in effect in the Czech Republic. Provisions regulating the unauthorised possession and other "handling" of drugs (psychotropic substances) are newly defined under the paragraphs 283-289 of the Penal Code. Further regulation is in the Act No 200/1990 Coll., including amendments as of 1. 1. 2010 (Misdemeanours Act), and the Government Decree No 455/2009 Coll. and No 467/2009 Coll. No major changes in the Czech drug legislation were adopted, in comparison with the previous regulation. From the minor changes made, the main change is, that a new article about cannabis cultivation for own use at greater than small amount (article 285) was adopted. A cultivation of small amount (5 plants) is a misdemeanour (by Misdemeanours Act, with penalty up to 15 000 CZK). Amounts of drugs for personal use are newly regulated by Government Decrees; government decree is clear, and generally binding (as distinct from internal instruction for police and state attorneys and by the "old Penal Code"). In general, the new Penal Code could be perceived as more strict for problem drug users (formal conception of new Penal Code leaves no/very small room for personal needs of drugs - as distinct from vague "old Penal Code" without generally binding government decree). A possession of cannabis for personal use has more light penalty as a possession of other drug (article 284/1, 284/2) - but only in case "greater than small amount", not in case large amount etc. (article 284/3, 284/4 doesn't distinguish between type of drugs). From different non-Czech media sources, information about the recent "legalization" of cannabis can be heard, and have unfortunately created a wrong medial picture of “legalization” of drug (some types of drugs) in the Czech Republic. Therefore it is necessary to be stressed here strongly, that despite the fact, that there are changes in the provisions regulating the unauthorised possession and other "handling" of drugs within brand new Penal Code valid in the Czech Republic by the 1st of January 2010, drugs including cannabis are still illegal and no major changes concerning the limits defining the amount for the "personal use" occurred. The amounts were just defined in a more binding manner including the court processes, which was not the case previously.
